Nagpur Bench of Bombay High Court

Nagpur: The Nagpur Bench of Bombay High Court, on Monday, adjourned a PIL seeking stay on proposed felling of 4,930 trees of Ajni Vann for Inter Modal Station (IMS) project, to the first week of July.

Since the very source of number of trees could not be placed before the High Court, a Division Bench comprising Justice Sunil Shukre and Justice Anil Kilor indicated that they would hear the matter after petitioners Shweta Burbure and Ajay Tiwari obtain information under Right to Information (RTI) Act from Nagpur Municipal Corporation (NMC). NMC informed the High Court that its proposed hearing had been postponed to June 30 and after the civic body’s public hearing, the petition might become infructuous or might survive.

Senior Counsel C S Kaptan informed the court that on behalf of petitioners, necessary record had been inspected and requisite information would be provided in the next couple of days. Since the process of filing of objections is on after which a public hearing is scheduled, he suggested postponing the hearing after the statutory procedure was over.

Adv M Anil Kumar informed that National Highway Authority of India (NHAI) had mentioned in its application the number of trees along with details of species and stated that number had been disclosed by NMC in its public notice inviting objections and suggestions from citizens. Under the Maharashtra (Urban Areas) Protection and Preservation of Trees Act, 1975, NMC is duty-bound to protect the trees, the petitioners contended while seeking to draw attention towards the recent amendments to the Act proposed by State Cabinet last week granting heritage status to trees older than 50 years and constitution of State Level Tree Authority to consider any proposal to chop off more than 250 trees.

The High Court, after a brief hearing, adjourned the matter till July. The PIL has opposed the move of the civic body to chop off fully grown trees leading to devastation of Ajni Vann and questioned the very need to cut the trees for IMS. Under the Maharashtra (Urban Areas) Protection and Preservation of Trees Act, it is the duty of NMC to protect trees. But its Tree Authority is merely granting permission to reduce the green cover, the PIL noted while citing several instances of depleting green cover of the second capital of Maharashtra.

The petitioners also claimed that NHAI, which is the nodal agency to execute the project, has claimed that out of 7,000 trees only 1,940 trees would be cut while NMC had put the number at 4,930. The petition also raised doubts about the success of relocation of trees and claimed that all previous experiments yielded mixed results.

Nagpur: Following strong protests by parents demanding reduction in school fees , many schools in Nagpur have provided relief in view of Covid-19 pandemic. The schools include leading groups like Bhavan’s and Modern among others which have provided help to the parents, many of whom either have lost their jobs or their business has been adversely affected due to lockdowns.

In its gesture, Bhavan’s has cut fees by 23 percent while Modern waived off charges of library and other extra-curricular activities. Notably, last year three schools – Prahaar, Kurvey’s New Model and Nahate Primary – had cut fees substantially in a relief to distressed parents, despite facing losses. The schools that have reduced fees claimed that they have not reduced salaries of their teaching and non-teaching staff though some of the prominent schools sacked some teachers.

Recently, members of various Parents Associations had assembled at Samvidhan Square (RBI Square) in Nagpur to protest against school fees and demanded that a minimum 50 percent reduction must be done. The Parents Associations claimed that the State Government recently has cut the school fees but the schools are recovering full fees from parents. An education activist, Mohd Sharif, said that the State Government has reduced RTE reimbursement by 50 percent because even the government knows that the schools are not incurring as much expenses as before. Similarly, the parents are demanding that a minimum 50% fee reduction must be done by the schools, he demanded.

Nagpur Today : Nagpur News

Nagpur: At a time when Covid-19 cases are declining substantially in Nagpur, various hospitals have started witnessing a steady surge in vector-borne and other diseases in children and adults alike with the onset of monsoon. The data of Nagpur Municipal Corporation (NMC) shows that 20 dengue patients have been reported in the city while the doctors suspected many more cases.

Hospitals are also reporting many cases of vector-borne diseases — malaria, chikungunya, gastro, stomach infections, with the onset of monsoon in the city. Local weather plays a vital role in the spread of infectious and vector-borne diseases. Monsoon is the transmission season for the majority of vector-borne diseases. Monsoon onset over Nagpur is witnessed towards the end of June and continues till September.

Vector-borne diseases are infections transmitted by the bite of infected arthropod species, such as mosquitoes, ticks, triatomine bugs, sandflies, and blackflies. Weather influences survival and reproduction rates of vectors. However, climate is only one of many factors influencing vector distribution, such as habitat destruction, land use, pesticide application, and host density.

The onset of monsoon in Nagpur is causing an increase in the cases of dengue and gastroenteritis. Children of all age groups, starting from a month to 18 years, are getting affected. The cases are on rise because of increased gatherings in marriages and unhygienic food preparations, according to a doctor.

A Government Medical College and Hospital (GMCH) doctor said patients woth complaints of viral fever, loose motions and vomiting could be seen these days, but it is not unusual. The number of cases is not at epidemic level, he said.

Another doctor said that it will take another two weeks to actually see the impact of water contamination or unhygienic food. The patient flow is routine for stomach infections, while jaundice cases are not seen so far.

The Court directs authorities to implement Nag River rejuvenation plan at the earliest

Nagpur: Terming the apathy of society and administration as worrisome, the Nagpur Bench of Bombay High Court called upon all Nagpurians and the authorities to make wholehearted efforts to rejuvenate Nag River and restore its past glory. Taking a suo-motu PIL based on ‘media reports about plight of Nag River and dirt and filth in Civil Lines area, a division bench consisting of Justice Sunil Shukre and Justice Anil Kilor enlarged the scope of the PIL and included cleaning of entire stretch of the river as it affected the environment and health of public at large.

The High Court, while seeking detailed response about efforts to clean Nag, Pili, and Pohra rivers, pointed out that the recent outbreak of pandemic should act as a wake-up call to all as any neglect of such water bodies could be detrimental to public health and hygiene. Pointing towards the river’s contaminated water polluting the Gosikhurd dam, the High Court asked all the authorities to tackle the root cause of pollution and contamination and not to undertake piecemeal efforts to clean stretches. A decade ago, the High Court had treated another media report on Nag River pollution as PIL and it ultimately led to commitment to construct sewage treatment plants (STPs) within defined time. Unfortunately, the promise was followed only in breach.

Describing Nag river as the signature river of Nagpur and lamenting over shocking apathy of all stakeholders in protecting it, the High Court had vividly described the pristine beauty of this signature river in the past while lashing out at the collective indifference of Nagpurians towards their treasure trove. Last year, the High Court took suo-motu cognisance of a report about dirt, filth and pig menace near Central Telegraph Office (CTO) and directed Nagpur Municipal Corporation (NMC) to take steps to clean the stretch. The news reports had highlighted absolutely shoddy work done by NMC at nullah near CTO compound due to which filth had accumulated on one side and foul smell was emanating from it.

Apart from pig rearing which had created a fresh nuisance for the nearby residents, the report had highlighted mushrooming encroachments in the Civil Lines area near CTO and other institutions and shocking official indifference to tackle this problem.

Expanding the scope of PIL, the High Court pulled up NMC for not clearing Nag River, delay in completing STPs and thereby reducing it to a stinking water channel. The Court stressed upon the need for doing more and stated that the work done by NMC was not enough.

Referring to Nag River bank abatement plan envisaged with the help of Japanese agency, the High Court noted that such a comprehensive effort was needed if the river was to be cleaned up and restored to its glorious position. The High Court then asked NMC and State Government to place on record the detailed plan to rejuvenate Nag River.

Nagpur: The Nagpur Municipal Corporation (NMC) has now started to organise on-site special vaccination camps for eligible people in the city. With this move, the civic body has discontinued the ‘Vaccination in Your Locality’ drive launched in the last week of May and continued it till the second week of June. The drive was launched to increase the number of vaccine beneficiaries in the city.

During the drive, employees of NMC working in 98 centres had visited community halls, indoor sports stadiums and other places in different localities and vaccinated the eligible citizens. Most of the people have been inoculated in selected localities. Hence the drive was discontinued and on-site special camps are being organised by NMC now, said an official of the civic body.

Following the footsteps of NMC, the Zilla Parishad has started ‘Vaccination in Your Village’ from the last week of May. But the response has been lukewarm as the number of beneficiaries has not been increased to a desired level.
