Excise Department yet to receive single application for liquor permit

Nagpur: The new normal of social distancing attributed by the global pandemic seems to have dimmed New Year’s revelries in the Second Capital of the State, as the Excise Department is yet to receive single application for liquor permit.

Come last month of the year and the party plans of New Years Eve receive full swing across the country and Orange city is certainly not an exemption! However, this year has been different since it’s dawn.

The Nagpur city which usually would gear up for numerous 31st bashes — from high voltage DJ to mouthwatering food coupled with booze the organizers promise revellers all — at the parties usually held in prominent resorts, clubs and farmhouses seems to have wore deserted look, this year.

Barely around 12 days left for 31st Eve and Excise Department has not received a single application for permit informed, Pramod Sonone, Excise Superintendent to Nagpur Today.

“We’re yet to receive a single application for permit regarding New Year’s Eve revelry. Though, things might change come Christmas. This year has already been though for everyone. However, we mustn’t lose the hope and welcome New Year as new dawn!,” says Excise Superintendent.

Owing to late night parties, the organizers are often use booze to rope in revellers on 31st Eve. However, such parties are often seen violating norms of Excise Department when it comes to drinking. The State Excise Department of Nagpur has decided to tighten the noose around such parties and booked the organizers if they are found serving liquor sans valid permit from the department.

National Galleries of Scotland preserves photo of Raje Raghuji III

Nagpur Today : Nagpur News

National Galleries of Scotland has kept in its collection the photo of Nagpur Ruler Raje Raghuji III and British Resident Sir Thomas Wilkinson of June 1844. This is an authentic photograph of Raghuji III and Sir Thomas Wilkinson, who was Resident Political Agent of Governor General of India (East India Co.) at Nagpur. Also, this is the only known photograph of Raghuji III. This is the first known photograph taken in Nagpur. This is one of his earliest photographs taken in India.

Daguerreotype photograph (named after Louis Daguerre, the French inventor) was developed in 1830s and publicised in 1839. A mirror polished thin layer of pure silver was coated on copper plate. It was then exposed to iodine and other halides. It was then used in camera obscura as photographic plate. The image formed on the plate due to effect of light (it required strong sunlight) on silver halide was preserved by exposure to mercury fumes. As the surface was still sensitive to touch and physical damage, it was placed in case and the glass was separated form photo by a 2 mm thick border of some material. The border was then sealed on all four sides to protect the photo from climate/weather changes. Many early Daguerreotype photographs were mirror images that is left side was seen as right side and vice versa.

This can sometimes be decided by looking at buttons of the coat. If buttons are on right side of the person photo is real and if buttons are on left side of person it is mirror image. Sir (Col.) Thomas Wilkinson was 9th Resident Political Agent at Nagpur from November 14, 1839 to September 12, 1844. He was born in 1795 and joined Bengal Army as cadet in cavalry in 1810. He spent long time in Nagpur as officer of Nagpur Auxiliary Horse. In 1830 he was transferred to Political Department and posted as Agent in South West province (of Bengal Presidency) which is Orissa. His code for settlement of land and as guide for administration of civil justice is known as ‘Wilkinson’s Rule’ and was in use for about 125 years without any major change. He was in favour of allowing to adopt an heir to Raghuji. He retired from Nagpur and went back to settle in London.

He was created a Knight Commander of Star of India in 1866. He died in 1867. Raghuji III was born as Bajiba, son of Banubai and Venkatrao Gujar, and grandson of Raghuji II (through his daughter Banubai), and was adopted by widow of Parsoji Bhosale and renamed as Raghuji III. He was born in 1808 and was adopted in 1818. He took charge of the state in 1828 on achieving majority. He died in 1853. He did not leave any legitimate son behind though he married 8 times. Nagpur state was annexed on his death by East India Co. He was last Sena Sahib Subha, a post created by Chhatrapati Shahu I, meaning Head of the army of the province (Gondwana and East including Bengal) to collect Chauth and offer protection to the province which was nominally belonging to the Emperor of Delhi and administered through his officers. Before 1832, the Raja of Nagpur when visiting Residency would carry his own masnad (a small cushion on a platform) to sit upon and would not use British chair. But one can see him sitting on a wooden chair here. Raghuji III started using chair or couch during Residency of Mr Henry Graeme who prepared a special couch for Raghuji.

The name of the photographer is not recorded. But a date, June 1844, is written on the photograph. The photograph and the case in which it is mounted is property of National Galleries of Scotland. The NGS has the copy right of the digital image of the photo. After realising the historical importance of the photograph, NGS has displayed it on its website (https://www.nationalgalleries.org/art-and-artists/10457/portrait-sir-thomas-wilkinson-and-raja-nagpur). (The author is a medical doctor. He is grateful to NGS for providing high resolution digital image of the photograph and permission to publish it in the newspaper.)

HC issues notices to state and accused in responce to appeal on behalf of the victim

The High Court responding to an appeal filed by the victim of the crime has issued notices to the state of Maharashtra as well as the original accused Dr Chetan Khutemate of Chandrapur.

Upon the complaint of the victim wife, offences under sections 498A, 323, 406, 504 and 506 of the Indian penal code as well as under section 4 of the Dowry Prohibition Act 1961 were registered against the accused.

The accused was put to trial before the learnedJudicial Magistrate First Class, Chandrapur and while the matter was subjudice before the court of the Learned magistrate, the High Court in an ancillary proceeding deemed it fit to expedite the trial and directed the trial court to complete the trial within a stipulated time. Accordingly, the trial proceeded and as many as seven witnesses were examined on behalf of the prosecution including the victim wife herself. Her real brother was also examined by the prosecution as a star witness who was in direct knowledge of the facts of the case. However, after the said brother of the victim recorded his examination in chief before the learned trial court, he could not remain present on the next date.

Interestingly on the said next date of the trial, even the accused was also absent and thereafter the learned magistrate closed the evidence of the brother of the victim acting in an undue haste. While, on one hand the learned magistrate closed the evidence of this witness on 8.2.2019, on the same day the magistrate also issued summons to him to depose further and to complete his evidence. Ultimately the trial court did not grant him an opportunity to complete his evidence and proceeded to discard the said evidence completely while rendering the judgement of acquittal in favour of the accused.

This haste shown by the learned trial court becomes further evident from the fact that the trial court also refused the request of the prosecution for calling the child witness in support of the prosecution apart from another witness. While turning down this plea of the prosecution, the trial court instead of rendering a finding on the merits of the application only rejected the said request on the ground that the matter was expedited by the High Court. Therefore the entire manner in which the trial was conducted caused great miscarriage of justice and hence the High Court while appreciating the submissions made on behalf of the appellant/victim wife admitted the appeal under section 372 of CRPC and issued notices to the state of Maharashtra as well as the accused Dr Chetan Khutemate.

Normally the courts have the option of seeking an extension of time from the Higher courts in case the time frame stipulated becomes insufficient for completing the case, but in this case, it appears from the order passed by the High Court that this is classic case where undue alacrity by the trial court went to the extent of completing trial at the cost of justice and embarking on the of notion of ”Justice Hurried Is Justice Buried”.

While issuing notices, as above, Justice Vinay Joshi at the High Court observed that the matter requires a re-look and admitted the plea of the victim wife.

The matter was conducted by criminal lawyer Advocate Aakash Gupta for the appellant wife and the state was represented by Mrs Jaipurkar the additional public prosecutor.
