Nagpur: Oficers attached to Anti-Corruption Wing of Central Bureau of Investigation (CBI) have booked Jagat Singh Bisht, former Assistant General Manager and Branch Head of Oriental Bank of Commerce, Kingsway, Nagpur, Kavita Narharshettiwar, sole proprietrix of Matoshree Construction Services, Wardha, and her husband Satish Vilasrao Narharshettiwar on charges of criminal conspiracy, cheating, forgery and criminal misconduct in a Rs 4.50 crore loan fraud case.

Matoshree Construction Services, Gajanan Nagari, behind G M Motors, Nagpur Road, Wardha, was engaged in real estate and civil construction. Through its sole proprietrix Kavita Narharshettiwar approached Oriental Bank of Commerce with a request to sanction bank guarantee limit of Rs 50 lakh and cash credit facility (hypothecation) of Rs four crores on July 31, 2013. After considering the request, the bank sanctioned the cash credit facilities of Rs four crores (sub limit of Letters of Credit – Rs 50 lakh interchangeable with cash credit and bank Guarantee of Rs 50 lakh) totaling Rs.4.50 crore to Matoshree Construction Services on September 25, 2013. Satish Narharshettiwar was the guarantor.

Kavita requested for renewal of her credit facilities in 2015. On March 26, 2015, the bank renewed the cash credit facility of Rs four crore. As she had not availed the bank guarantee of Rs 50 lakh, same was withdrawn. Kavita had mortgaged her property, including her residential plots (No. l to 60 (total area 7173.25 sq mts) located in Survey No.20/1/A/1/B (New), (Old Survey No.22) Mouza No.17, P.H. No.34 of Mouza: Injhapur, district Wardha, with Oriental Bank of Commerce to secure the loan facilities. Satish Narharshettiwar had extended the charge of Rs 4.50 crore on his residential plot No.l survey No.49, 3/B Mouza No.73 PH. No.22 of mouza: Nalwadi, by way of registered mortgage on September 27, 2013 before the Sub Registrar, Wardha. Kavita availed credit facilities sanctioned and disbursed in her favour by the bank.

However, she failed to adhere to the terms and conditions of the sanction, which was accepted by her and her husband unconditionally. There was a default of funds that resulted in slippage of the account to non performing asset (NPA) on September 30, 2015 as per the guidelines of Reserve Bank of India. The outstanding amount in the account of NPA Rs.4,52,82,916 till September 30, 2015.
After declaring the account as NPA, the bank has issued notice to Kavita and Satish Narharshettiwar to repay the outstanding amount of over Rs 4.52 crore within two months. As they failed to repay the amount, the bank had taken possession of charged securities as per law.

On February 25, 2016, Tirupati Urban Co-operative Bank Ltd informed that the immovable properties of Kavita and Satish Narharshettiwar attached by Oriental Bank in Wardha district were already mortgaged to them since October 8, 2012 and the District Magistrate had passed orders to the take possession of their properties.
Kavita and Satish Narharshettiwar concealed the fact of previous mortgage of their immovable property to Tirupati Urban Co-operative Bank Ltd and defrauded Oriental Bank of Commerce to obtain loan of Rs 4.50 crore.

The probe revealed that Jayesh Subhash Surve, Assistant Manager, had processed the proposal along with Jagat Singh Bisht, the then Assistant General Manager and Branch Head. Bisht, who is now Deputy General Manager, Cluster Monitoring Office (Inspection & Control), Oriental Bank of Commerce, Jaipur, had sanctioned the limits, allegedly for self gains from Kavita and Satish Narharshettiwar.

Nagpur Today : Nagpur News

Nagpur : Amid rumours that the State Government may postpone implementation of E-way bills for movement of goods within the State, Agrawal, Joint Commissioner, State Tax, Nagpur, told media on Thursday that the new system would be rolled out from May 25 (Friday).

“As per the directions of the Government, E-way Bill system for movement of goods within the State will come into effect from May 25. As there are no directions from the Government with regard to extending the date, we are all set to implement it,” he said.

Agrawal further said that the E-way bill system for movement of goods within the State was very similar to E-way bills for inter-state movement. “The system is already in place for inter-state movement of goods since April 1 and thus we believe that suppliers, receivers and transporters will not face difficulties. In fact, it will make the entire system transparent,” he said.

Under the Goods and Services Tax regime, all transporters moving goods worth more than Rs 50,000 have to generate E-way bill even from within the State movement. Till now, it was mandatory for only inter-state transfer of goods.
Interestingly, there were speculations in the markets that the State Government may postpone the implementation. Many traders and suppliers were seen reluctant to adopt the system.

Naresh Jakhotia, Joint Secretary of Vidarbha Industries Association and Tax Consultant, said that initially there will be some difficulties but later on the system would become smooth.

He said that objective of the policy makers is to bring in transparency in the system. “There is no need to panic. E-way bills are not new for all of us as we are already dealing within for inter-state supply of goods. more or less it a similar system. I think everyone will get accustomed to it in coming days,” he said.

NMC Nagpur

Nagpur: Maharasthra Government has directed Nagpur Improvement Trust (NIT) to complete the process of merger with Nagpur Municipal Corporation (NMC) by June 15. The final decision is likely to be announced during Monsoon Session of State Legislature slated to begin in the city from July 4.

A high-level meeting was held recently in this regard in Mumbai. Manisha Mhaiskar, Principal Secretary of Urban Development Department, conveyed the message of Devendra Fadnavis, Chief Minister, to complete the merger process immediately.

As per the decision taken in the meeting, NMC is ready to create a separate cadre of NIT officials joining NMC after merger. The civic body will protect their pay scale, seniority and pension benefits. Nagpur Metropolitan Region Development Authority (NMRDA) will also accommodate some staff members in its services by screening them.

As decided in the meeting, NIT will hand over all its assets like garden, playgrounds, undeveloped layouts to NMC along with the funds collected by them for development work in these layouts. After handing over the undeveloped layouts, NMC can undertake development works in these areas. Presently, a corporator cannot suggest a development work in these layouts due to a ban proposed by the State Government. Till now, NIT has handed over 399 layouts to the civic body.

The Government had fixed December 31, 2017 as deadline for dissolution of NIT and its merger with NMC. The decision to dissolve NIT was taken in December 2016 by the State Cabinet. Overlapping jurisdiction of NIT and NMC was a point of friction between both the agencies and there was a demand to scrap NIT or at least drastically curtail its powers for areas within 217 sq km area of Nagpur city. Maharashtra Government had taken in-principle decision in December 2016 to oust NIT from Nagpur and strip it off its jurisdiction within municipal limits.

As per the procedure, the Government will require to amend Rule 121 of NIT by-laws to pave way for the Trust’s dissolution and its merger with NMC. The Government will have to table these amendments before the State Legislature. As an alternative, top sources claimed, the Government might issue an Ordinance to dissolve NIT. But even for that to happen, amendments would be needed in relevant sections of NIT by-laws and also in Maharashtra Municipal Corporation Act. As suggested by the high-powered committee in view of the present rules, the staff from NIT can only join NMC after the merger. To accommodate the staff in NMRDA, the Government will have to first amend the by-laws.

The Rule 121 of NIT by-laws states, “When all the schemes sanctioned under this Act have been executed, or have been so far executed as to render the continuance of the Trust, in the opinion of the State Government, the Government may by notification declare that the Trust shall be dissolved from such date as may be specified in this behalf in such notification, and the Trust shall be deemed to be dissolved accordingly.”

NIT is yet to complete some projects under its jurisdiction including development of undeveloped layouts and seven street schemes. Also, there are legal hurdles to clear. The official note filed before the High Court by Amicus Curiae Anand Parchure in a PIL dealing with bungling in NIT has charged that assets and liabilities of the Trust including all subsisting contracts are being transferred to NMC without any notification issued under Section 121 of the NIT Act.

Against this backdrop, the process for NIT’s merger with NMC was taking. Now, the Government has asked NIT to complete the process latest by June 15.

Nagpur Today : Nagpur News

Nagpur/Bhandara: Union Minister Nitin Gadkari has called former BJP MP Nana Patole as ‘most arrogant and egoistic’ person he had ever met. Gadkari was addressing an election meeting at Bhandara for the May 28 Lok Sabha by-poll being held for Gondia-Bhandara seat. “This by-poll was forced on people by Nana Patole who resigned from BJP and Lok Sabha. Patole is arrogant and egoistic person. BJP will not only ensure his defeat in this by-poll but will finish him politically from Sakoli area. We will win this Lok Sabha by-election over development issue and not by caste politics,” the Union Minister declared.

Gadkari was addressing election meeting at Railway Ground in Bhandara for party candidate Hemant Patle. The meeting was also attended by Union Minister Ramdas Athawale and Guardian Minister Chandrashekhar Bawankule.

In Bhandara-Gondia, the competition is between BJP’s Hemant Patle and NCP’s Madhukar Kukde supported by the Congress. The seat fell vacant after BJP MP Nana Patole resigned and later joined Congress. Voting will be held there on Monday, May 28, which has been declared a holiday in both the districts. The by-election was forced because of resignation from Lok Sabha by Nana Patole who was elected in 2014 on a BJP ticket.

Gadkari further said, “As Transport Minister since the past four years, 14-lane highways were built first time in the country. For ensuring overall development of Bhandara district, efforts are being made to start Bhandara-Nagpur Metro Rail. The Congress rule has made the condition of farmers miserable. The previous government did nothing for farmers. On the other hand, our government launched various schemes for welfare of farmers. A factory producing ethanol from tanas is being set up as part of welfare schemes for farmers,” Gadkari said.
