HC quashes FIR against forest officer in suicide abetment case

Nagpur: The Nagpur bench of the Bombay High Court on Friday quashed an FIR registered against suspended senior forest officer M S Reddy in an abetment of suicide case.

Reddy, who had been made a co-accused in the suicide of a woman colleague, range forest officer (RFO) Deepali Chavan early this year, had filed a petition in the HC’s Nagpur bench for quashing of the FIR registered against him by the police in Maharashtra’s Amravati district.

In its order, a division bench of Justices G A Sanap and AS Chandurkar said there was no material whatsoever to attract the provisions of section 306 (abetment of suicide) of the Indian Penal Code against Reddy in the case.

“In the light of the principles laid down in State of Haryana Versus Bhajanlal (1992) and especially illustration nos.1 and 3 thereof, continuation of the present proceedings against the petitioner would thus amount to an exercise in futility thus resulting in abuse of the process of law,” the court observed and quashed the FIR.

Reddy, earlier suspended in connection with the suicide of Chavan, who was RFO at the Melghat Tiger Reserve (MTR), was arrested on April 29 this year by the Amravati rural police.

Chavan had committed suicide by shooting herself with a service weapon in March this year allegedly due to harassment by senior officials.

In a purported suicide note, she had levelled allegations against her senior officer, Deputy Conservator of Forest Vinod Shivkumar, who is the main accused in the case and had been arrested earlier.

In the note, Chavan had said that Reddy, then Field Director at the Melghat Tiger Reserve, had failed to take action against Shivkumar despite her complaint to him.

Firing at Geetanjali Square: Tehsil cops nab four accused, seize car

Nagpur: Tehsil Police arrested four goons for attempting to kill history-sheeter Mohsin Ahmed alias Mohsin Akola in front of Geetanjali Talkies and recovered the firearm used by them for committing the crime. Cops also seized a Maruti car from their possession.

The accused have been identified as Mohammad Mushfique Khan alias Mussa Mohammad Shakeel (27), a resident of Naka No 2, Raza Town, Kamptee, Kamran Nakib alias Kammu Ashpak Ahmed (24), a resident of Mominpura, Sayyed Imran alias Immu Sayyed Jamil (25), a resident of Timki, Teenkhamba and Altaf Mirza Iqbal Baig Mirza (35), a resident of Takia, Diwanshah.

The accused had an enmity with Mohsin Ahmed and hatched a plan to eliminate him.

In the small hours on August 9, they came near Geetanjali Talkies. Prime accused Mohammad Mushfique took out a pistol and shot at Mohsin. The bullet pierced through Mohsin’s thigh. A resident of G-5, Amar Heritage, Jafar Nagar, Mohsin was rushed to Mayo Hospital. Cops first nabbed Mohammad

Mushfique and Altaf. Later, they took the other two accused into custody. The arrests were made by Senior PI Jayesh Bhandarkar, API Sandeep Bagul, PSI Swapnil Wagh, ASI Sanjay Dubey and others under the supervision of Commissioner of Police Amitesh Kumar, Additional CP (North Region) Navinchandra Reddy, DCP (Zone-III) Rohit Matani and ACP (Kotwali Division) Sanjay Surve.

Sitabuldi Fort to remain closed for public on I-Day

Nagpur: Considering the prevailing Covid-19 situation, the historic Sitabuldi Fort will remain closed to the general public on August 15, the Independence Day. R Vimala, District Collector, has taken the decision under the provisions of Disaster Management and Epidemic Diseases Act.

Every year, Sitabuldi Fort is open to the public on Independence Day. However, this year it will remain closed due to COVID-19, stated a press release.

Bhandara Hospital Fire: HC grants pre-arrest protection to nurses

Nagpur: In a major respite to the two nurses of Bhandara Civil Hospital, who were booked in an unfortunate fire incident that claimed lives of 10 newborn babies back in January 2021, the Nagpur Bench of Bombay High Court has granted them pre-arrest protection recently.

According to applicants Shubhangi Sathawane and Sunita Masulkar, they were in no way responsible for the unfortunate incident and stoutly denied any negligence and sought protection. Bhandara Police had booked both staff nurses for the offence punishable under Sections 304 read with Section34 of the Indian Penal Code and blamed them for causing deaths of newborn babies on January 9, 2021 due to negligence.

The applicants claimed that neither safety instruments were installed in the hospital nor attentive measures were undertaken at the relevant time.

The Sessions Court had granted pre-arrest protection to both applicants on January 29 but the anticipatory bail application came to be rejected on August 3.

Justice Vinay Joshi, while extending protection to both the applicants, asked them to attend the concerned police station every Sunday and Wednesday between 11 am and 2 pm.

Adv N G Mohrir appeared for the applicants while APP Indranil Damle and APP Harshal Dubey represented the State.

Nagpur PSI on KBC Hot Seat, wins ₹12.5 lakh in reality show

Nagpur: Police Sub-Inspector (PSI) Mangala Harde (Nandgaye), attached to Social Security Branch (SSB) of the City Police, took part in ‘Kon Honar Crorepati’ (Marathi version of the popular TV reality show Kaun Banega Crorepati) on Sony Marathi Channel on Friday night.

PSI Harde was selected to take the hot seat and won ₹12.5 lakh in reality show featuring Marathi actor Sachin Khedekar as the anchor.

Commissioner of Police (CP) Amitesh Kumar and Deputy Commissioner of Police (Detection) Gajanan Rajmane had already extended support and co-operation to PSI Harde to participate in the popular show.

It was a thrilling Friday night for Nagpurians to watch the young woman police officer from the city, channelising her power of knowledge on the hot seat.

Miscreants attack youth at Café Khoka in Sadar

Nagpur: Sadar Police have booked three youths for allegedly attacking an 18-year-old teenager with fiber rods at Café Khoka here on Friday evening.

Based on the complaint lodged by the victim Pawan Pradeep Tadse (18), a resident of Satranjipura, Itwari, cops have booked accused Akshay Madavi and his two accomplices under Sections 324, 504, 34 of the IPC.

According to police sources, Pawan along with his friends had visited Café Khokha on Friday evening. At around 4.30 pm, Akshay along with his two friends reportedly stormed inside the café and picked up an argument with Pawan over an old argument. During a heated exchange of words, Akshay reportedly attacked Pawan with fiber rods before hurling abuses at him. Pawan who sustained severe injuries on his head and back then approached Sadar Police Station and filed a complaint.

Miscreants steal Apple gadgets, Rs 7 lakh cash from two cars within an hour in Sitabuldi

Nagpur: In two separate incidents, some miscreants stole electronics of Apple Company, vital documents and cash worth over Rs 7 lakh by breaking into two cars on Friday. The incidents of theft were reported in the span of one hour under Sitabuldi Police Station. It is pertinent to mention that this was 7th such incident in the last 10 days. Deputy Commissioner of Police (DCP) Zone 2, Vinita S, said that cops have already made a breakthrough in four incidents of car thefts.

In first incident, complainant Aditya Shailendra Agrawal (22), a resident of Flat No. 28, Kesar Building, Jalram Nagar had parked his Maruti Swift Dzire (MH/49/BB/8289) near Shrimohini Complex and had gone to UTI Office on Friday between 11.40am and 12.20 pm. In the meantime, some miscreants reportedly smashed the rear window of his car and decamped with Macbook, iPad and iPhone collectively of Rs 1.30 lakh kept on the rear seats.

Barely half hour after this incident, a group of thieves decamped with cash Rs 7 lakh, vital documents and a laptop from a car by deceiving the driver at Lokmat Square.

According to sources, complainant Deendayal Rahangdale, who works as a driver for Vasudev Jhamnani had taken the latter to see a doctor at Lokmat Square. While Jhamnani went to see the doctor, complainant Rahangdale was in the car. During the same, a youth approached Deendayal saying that his money had fallen on the ground. As Rahangdale got down to look for the money, one miscreant took cash and laptop from the other side of the car and fled the spot.

Meanwhile, Rahangdale took the note lying on the ground, unknowing of the theft. It is only after Jhamnani came back, the theft came to fore. Following which a complaint was lodged with Sitabuldi Police.

When Nagpur Today took issue to Deputy Commissioner of Police (DCP) Zone 2, Vinita S, she informed that, cops have already made a breakthrough in four incidents of car thefts. The accused have been apprehended and investigation is underway. Cops are on their toes to curb the rising menace of breaking into cars and stealing, the DCP assured.

Stray cattle pose threats to commuters, pedestrians on Nagpur roads

Nagpur: The problem of stray cattle is no taboo to commuters and pedestrians of the Second Capital of the State. Be it several prominent avenues, flyovers or interior roads, herds of stray cows and buffaloes roaming or seating often pose obstacles to traffic. Despite an alarming rise in the number of road accidents owing to the stray cattle, the concerned authorities have failed to curb the menace.

Several commuters riding their two-wheelers have been injured after their vehicles skidded because of cow dung on the road. However, Nagpur Municipal Corporation (NMC) and District Administration seem to be mute spectators to the issue.

The civic body is ill-equipped, with less man-power to impound large numbers of cattle. As a result, herds of stray animals roam freely on the busy streets causing hindrance to traffic.

According to commuters, they face the cattle menace on the thoroughfares quite frequently. While the unexpected appearance of the cattle on the road leaves people surprised, they cannot even be spotted if it is night time. Such incidents not only pose a grievous threat for humans but many animals end up with severe injuries attributed to such mishaps.

Covid-19: Nagpur reports 9 fresh cases, no casualties, active cases at 123

Nagpur: The Nagpur district on Saturday reported nine fresh cases and zero deaths attributed to novel Coronavirus (Covid-19). In the last 24-hours, 10 persons recovered from the virus borne disease.

While four cases were reported from Nagpur Municipal boundaries, three cases were reported from Nagpur rural and two were from outside the district.

With the latest update, the cumulative positive cases reached 4,92,968 and the number of deaths stand still at 10,118. The sum of 4,82,727 people have been successfully recovered from the virus borne disease.

The Covid recovery rate of Nagpur district stood at 97.92%, while active cases stand at 123.

“Fully Vaccination” condition precedent violates fundamental right to livelihood: Dipen Agrawal, Convener Sangharsh Samiti

Nagpur: The members of most affected sectors led by Dipen Agrawal convener of Sarkar Jagao Vanijya Bachao Sangharsh Samiti (SJVBSS) called upon Minister of Power and Guardian Minister for Nagpur District, Dr. Nitin Raut to convey their gratitude for taking stock of ground reality and impressing upon local authority Municipal Commissioner, NMC to issue order dated 08/08/2021 to open-up economic activities in city to protect the livelihood of many in Nagpur. Particularly in the backdrop of Chief Minister, Uddhav Thackeray’s announcement declining immediate relaxation in restrictions.

Dipen Agrawal said that state government order dated 11/08/2021 and consequent orders issued by Collector Nagpur and Municipal Commissioner, NMC to take effect from 15/08/2021 has practically reversed the relaxation. The orders stipulates’ that owner and staff of shops, malls, restaurants, bars and banquet halls should be fully vaccinated and 14 days should have passed after second dose. The orders further prohibits’ entry of persons in malls if they are not fully vaccinated and 14 days have not passed after second dose.

Dipen Agrawal further said that the condition of fully vaccination violates the fundamental rights of freedom to carry on any occupation, trade or business of a particular category or class of citizens who are otherwise entitled to do so, making the order ill-conceived and arbitrary. The order restricts the fundamental right to life of an individual by stripping off his/her right to livelihood.
Dilip Kamdar, co-convener, said that even though the intention of State government being in nature of welfare of mases there should be no room for coercive or negative reinforcement of vaccination by seizing the right to livelihood of citizens. The right to and the welfare policy for vaccination should not affect a major fundamental right; i.e., right to life, personal liberty and livelihood, especially when there exists no reasonable nexus between vaccination and prohibition of continuance of occupation and/or profession.

Micky Arora of Sangharsh Samiti highlighted that, the Union government announced and authorised states to vaccinate persons in the age group of 18 to 44 years from 01/05/2021. However due to paucity of vaccines the State government suspended the vaccination of 18 to 44 years from 12/05/2021. Further after resuming vaccination for persons in age group of 18 to 44 years, on 19/06/2021 State government restricted and prioritised vaccination of persons in age group of 30 to 44 years and fully opened vaccination for persons above 18 years from 22/06/2021. In this background state is not justified in imposing the fully vaccinated condition, he added.

Vijay Talmale said that till date supply of vaccine is not stabilised and thus government vaccination centres in Nagpur are operational only for 2 or 3 days in a week. Union government has increased the duration between two doses of ‘Civishield’ vaccine from the initial notified gap of 4-8 weeks to 8-12 weeks and to current gap of 12-16 weeks in June 2021 and further informed that vaccination of persons below 18 years is not yet started.

Rajnikant Bondre President of Associations of Coaching Institutes said that, the State government order dated 11/08/2021 has not placed any new restriction on Coaching classes. However local authority Municipal Commissioner Nagpur has withdrawn the permission given to operate coaching classes at 50% capacity under its order dated 08/08/2021. The uncertainty and frequent unilateral change is adversely affecting students from Nagpur preparing for competitive exams, he added.

Summing up, Dipen Agrawal on behalf of most affected sectors of the economy requested Dr. Raut to impress up-on the State Disaster Management Authority to harmoniously construct of the provisions of law and principles of equity, good conscience and justice and instead of mandatory condition of fully vaccination prescribe condition that owner of shops, malls, restaurants, bars and banquet halls to ensure that their staff and visitors are at least vaccinate once (first dose) and exempt persons below 18 years from this condition; also direct the local authorities at Nagpur to restore operations of Coaching Classes at 50% strength, so as to secure the interest of most affected segments of economy due to frequent lockdowns.

Dr. Nitin Raut responding to the facts and circumstances highlighted by Sangharsh Samiti said that he has strongly advocated for the Sangharsh Samiti’s demands in Cabinet Meeting and has left no stone unturned to give relief to the most affected sectors due to persistent lockdown. He assured that he will continue his efforts to bring justice for the last man in the chain.

75th Independence Day celebrated At DPS Mihan

Delhi Public School MIHAN celebrated 75th anniversary of India’s freedom with great zeal and fervour on 15th August 2021, in school premises in adherence to all covid 19 protocols. Enthusiastic participants from std VIII and IX, PTA members and teachers, all gathered in school for the flag hoisting and other celebrations. The programme was live on Facebook. Other students joined online.

The participants shared their thoughts confidently as they emphasised on ‘AazadiKaAmritMahotsav’-an initiative by the government of India to celebrate and commemorate 75 years of progressive India. Cops raid bootlegger’s house, seize illegally stocked liquor

Nagpur: Mankapur Police raided the house of a bootlegger and seized illegally stocked 456 bottles of country liquor worth Rs 27,360 on Wednesday night. Cops booked accused Montu Ramesh Chandrikapure (28), a resident of Indira Mata Nagar slums in this connection.

A team of Mankapur Police comprising Senior PI Vaijayanti Mandavdhare and PSI Mishra, under the supervision of DCP (Zone-II) Vinita Sahu and ACP Trupti Jadhav, raided Chandrikapure’s house and seized 465 sealed bottles (each containing 180 ml liquor) which were illegally stocked.

Police registered a case under Section 65(e) of the Maharashtra Prohibition Act against Chandrikapure.

Motorcyclist killed in mishap

Nagpur: A Motorcyclist was killed while the pillion-rider sustained injuries as the two-wheeler skid on the road in Katol area. The deceased was identified as Snehal Khobragade, a resident of Pili river, Kamptee Road.

According to police, Snehal and Anilesh Nilesh Bansod (21), a resident of Saubhagya Nagar, Hudkeshwar road, were heading towards Nagpur from Narkhed on Thursday.

Snehal was riding the bike. He lost control over the wheels near Kalambha village. As a result, the bike skid on the road and the two fell down. Snehal sustained grievous injuries on head in the mishap. He was admitted to a hospital where he succumbed to the injuries.

A case under Sections 279, 337 and 304 (a) of Indian Penal Code read with Section 184 of MVA was registered by Katol police.

Selfie Tragedy: Two brothers drowned while clicking selfie in Gosekhurd dam

Nagpur: Two brothers drowned in Gosekhurd dam while one of them was trying to take a selfie on Sunday. The deceased identified as Mangesh and Vinod Junghare had gone to Gosekhurd dam on the occasion of 75th Independence Day.

In a bid to use the most picturesque background for the frame, Mangesh reportedly slipped into the swirling waters. Seeing him grappling to stay afloat, Vinod dived in to save him. The onlookers were stunned on seeing two men swept away. Some have also filmed the entire episode, the video of which has been taking rounds on social media platforms. Mangesh has a four-year-old boy while Vinod has a year-old girl.

Onlookers then alerted the Police. Following which a squad of cops and CRPF officials approached the spot. Swimmers were also roped in to find the two missing brothers, both residents of Umred. The bodies were fished out following a long search operation. A case of accidental death has been recorded in this regard.

NCP’s Jwala Dhote leads CSWs agitation against cops over sealing Nagpur’s red-light area

Nagpur: Several Commercial Sex Workers (CSWs) led by National Congress Party (NCP) leader Jwala Dhote on Sunday staged a protest against the Nagpur Police over sealing a Ganga-Jamuna brothel in the Second Capital of the State.

The agitators removed barricades put up by the police restricting entry of people to the area under section 144 of the CrPc. It is pertinent to mention that the Ganga Jamuna area was sealed on Wednesday evening on the order issued by the city police commissioner after several residents complained about open solicitation by CSWs and other illegal activities.

A group of more than 100 sex workers led by Dhote raised slogans against the police this morning. Some of the women removed barricades prohibiting entry to the 12 lanes in the area.

Speaking to reporters, Dhote alleged the police are helping builders to grab the prime land by barricading the area.After sealing the area and imposing section 144 of the CrPC, which prohibits the gathering of four or more people in a specified area, police also conducted house-to-house searches. She also vowed to launch a stir after Independence Day celebration against Nagpur Police’s arbilatory action.
