Nagpur: In a major respect to the top ranking officials of the Bharat Sanchar Nigam Limited, Nagpur, the District & Sessions judge AV Dixit has today granted anticipatory bail to all the accused.

The matter pertains to the suicide of one Anand Babaria, outside the premises of BSNL Nagpur on 23rd of February 2018 in his car. It was alleged that the deceased was himself a Contactor working for the department and who had done the work of laying optical fiber cables in the National optical fiber network project announced by the Prime Minister. It was also alleged that officials of the BSNL department were not clearing the outstanding bills submitted for the said work. It is interesting to note that the said dispute with the BSNL department had also been referred to arbitration proceedings and the arbitrator had passed an award in December 2017.

In fact, a deeper probe in the matter revealed that in fact the contactor appointed by BSNL was one private limited company – Mak Infratel private Limited from Delhi and the deceased was only the representative working for the said company. It also transpired that in fact the contactor company itself had not complied with the necessary formalities as we are mandated in the tender conditions as well as the arbitral award and which were necessary for processing of its bills. Failing the mandatory compliances, it was not legally possible for the department to have cleared any of the bills of the contactor company. The department also claimed that the contactorcompany had not returned the balance unused material which was entrusted to it by BSNL, worth of which was over Rs.24 lakh.

In the above circumstances, the death of said Anand, however unfortunate it is, he named top officials of the department including the General manager Telecom Nagpur District Mrs Namratta Tiwari who is an ITS officer and other senior officials claiming that the said officials were responsible for the withholding of bills of the company, leading him into committing suicide. Apart from the written suicide note, the police papers revealed that the deceased had also left behind a video recorded by himself just before his death that gave an account of reasons for his taking the penultimate step of ending his life. During the course of arguments, it was urged that the said video be produced before the court by the prosecuting agency to reveal the truth in the matter and that the said video contains the real reasons for the for the deceased to have ended his life. The prosecution submitted that the video is seized and was being examined by them. It was also strongly urged that in the said video, the deceased gave plenty of personal reasons due to which he was extremely distressed.

And due to which he was ending his life. The District and Sessions judge, considered the law laid down by the Supreme Court as well as the High Court on the point of section 306 of the Indian penal code and as to what constitutes an abetment and more important that without the requisite intention on part of the accused, that the other person should commit suicide, the ingredientsof the offence of abetment of suicide are not made out.

In the aforesaid facts and circumstances of the matter, the District judge confirmed the ad interim bail granted to be accused and directed the release of the BSNL officials and the contractor Tripathi. However, be court has put all the accused on strict conditions and has directed them to appear before the police as and when called upon and also to refrain from tampering with the documentary and other evidences and also to attend Police Station as and when called.

The applicants were represented by Senior Counsel Avinash Gupta and Advocate Aakash Gupta, while the state was represented by Advocate Rashmi Khaparde. The complainant also engaged Adv Chauhan to assist the prosecution and to oppose the bail of the applicants.

Here is How to Stop Annoying Calls to link your Aadhaar number

Nagpur Today : Nagpur News

Nagpur: Are you still getting calls from your bank, mobile wallet and credit card companies to share your Aadhaar number? Do they still insist on your Aadhaar number even when you have already shared other documents with them? If you have been getting such calls you can always turn the request down as the Supreme Court has already extended the deadline for linking of Aadhaar card.

There have been cases reported where third party administrators (TPAs) are asking for Aadhaar number for processing of health insurance claims. In case of denial by policy holders they are delaying the claim settlement. In such a situation one is left with no option but to share Aadhaar number as very few can fight when their loved ones are fighting with an illness in a hospital.

If you come across such a situation, it is always good to tell the person on the other side to show you documents where it is written that submission of Aadhaar number is mandatory. You can always deny and argue with the person citing the recent Supreme Court direction that sharing of Aadhaar number has not been mandatory yet.

The five judge constitution bench comprising Chief Justice Dipak Misra, Justices A K Sikri, A M Khanwilkar, D Y Chandrachud and Ashok Bhushan, said, “We direct that the March 31, 2018, deadline for linking of Aadhaar with various services and welfare schemes stand extended till the matter is heard and judgement is pronounced by the constitution bench,”

The question arises when it is not mandatory why financial institutions have been pressing so hard for it. Why consumers facing unnecessary harassment on the hands of these institutions when it is not compulsory yet. Financial institutions on the other hand complain that they are asking for Aadhaar card because of pressure from the government. In such a scenario shouldn’t government and financial institutions wait till the final verdict of the Supreme Court is out.

Given how busy our lives are it is not fair to bombard us every now and then with the mail, message and call on linking of Aadhaar. And what if we link the Aadhaar and Supreme Court says that it is not mandatory, wouldn’t be people who have already linked their Aadhaar number be at loss.

It is a request to all financial institutions from stop asking for Aadhaar until the final judgement is out. Till then please stop harassing the common man in the name of Aadhaar.

Nagpur Today : Nagpur News

  • Long weekend and few bank holidays coming ahead of 31st March
  • More than 1.5 Lac consumers have their prompt payment dates in next 2-3 days
  • SNDL decided to extend the dates till 31st March to benefit consumers by passing on discount
  • SNDL has also initiated the ‘collection-on-call’ facility for office-goers who are busy in FY closing

SNDL Nagpur
Nagpur: An upcoming long weekend is around the corner with Mahavir Jayanti on Thursday (29th March), Good Friday (30th March) followed by just one day of working on 31st of March which would again be followed by another day off on 1st of April (New financial year). The closure of financial year is of great importance to many organizations, and most of the individuals work beyond their regular timings to close it well. In such a scenario it is likely that utility bills and other pending chores may take a backseat for a while.

This may include electricity bills which might remain neglected for sometime and may cause inconvenience later. To help people avoid this inconvenience, SND Limited Nagpur has decided to extend the prompt payment dates for all such consumers whose prompt payment dates are falling between the 28th and 30th of this month. This also means that a large number of payment centres of SNDL Nagpur would be operating during regular timings on all of the holidays ahead till the 31st of March. It was observed that more than 1.5 Lakh consumers had their prompt payment dates falling during these bank holidays. In view of this, SNDL team decided that in larger interest of the public, the consumers should not be deprived of prompt payment discount, however small the amount maybe. It was thus decided that the consumers may pay off their complete bills till 31st of March and avail the prompt payment discount even on the last day of this financial year. It may be noted that prior to the last prompt payment date, the utility offers a ‘prompt payment’ discount of 1% of the current bill (devoid of any arrears). This discount is offered by the distribution franchisee to cultivate a discipline of timely payment of utility bills amongst citizens.

Collection-on-call till 31st March 2018

Besides the above, the franchisee has also come up with another facility till 31st of March. Considering the pressures of financial year closure on consumers from various walks of life, SNDL has initiated a ‘collection on call’ service. Under this facility, one or more consumers from same office can make a phone call to the SNDL toll-free number 1800-313-9600 and ask for this facility. SNDL collection team would visit the office and collect the bill payments and also issue instant receipts. The consumer has to inform his/her consumer no to the visiting officer of SNDL to initiate payments.

Both the above facilities have been launched keeping in mind the pressure on its consumers during this period where everybody usually works extra hours for closure of financial year books of accounts in their respective offices. It is expected that both these facilities would help these consumers avoid any inconvenience such as disconnection and penalties later.

Nagpur: The traffic signals regulate road traffic, avert traffic jams, curb haphazard traffic, and most importantly, avoid accidents. The signals play the role of policemen, albeit, silently and systematically. But the same traffic signals at major squares in Nagpur have either gone ‘dead’ or have been shut down owing to ongoing Metro Rail work and other development activities such as cement roads.

With the Metro Rail work progressing fast along second phase of Ramjhula work, installation of traffic signals at this junction has not been taken up so far. But the vehicular traffic is going on smoothly thanks to “traffic controllers” of Metro project. The ‘traffic controllers’ have assumed the responsibility of traffic cops and doing their new job with aplomb.

After treading a few kilometres in jungles, the two students sought help of passers-by and informed their relatives about the shocking incident.

Harjit Singh Bhatti and Manoj Ujjwalkar, both relatives of the students, said that they received phone calls from school informing them that Jagdish and Mohit ran away from school. The information triggered panicky and the relatives started a search for them. But it was only after they received calls from Jagdish and Mohit that the entire sordid episode came to the fore. The two students were admitted to a hospital with injuries on their hands, legs and even at private parts.

The relatives of both Jagdish Bhatti and Mohit Ujjwalkar have lodged complaints with police and demanded strictest action against the accused Director Colonel of Sanmitra Sainiki Vidyalaya.

In another interesting twist, it is learnt that RSS Chief Mohan Bhagwat, Union Minister Hansraj Ahir and Maharashtra Finance Minister Sudhir Mungantiwar among others are members of executive committee of Sanmitra Sainiki Vidyalaya. However, the fact has not been verified.

According to unconfirmed reports , One Union Minister , State Minister in Fadnavis govt and an Hindu organization Chief are the members of executive committee.

justice-loya

Nagpur: “Judge B H Loya died of natural causes. Nobody doubted about the cause of his death for three years. Three years after, the English magazine ‘Caravan’ published a report over Judge Loya’s death which is nothing but a blatant lie,” claimed the Chief Minister Devendra Fadnavis while making a statement in Assembly on Tuesday.

Fadnavis said in clear terms that Judge Loya died of natural causes. Judge Loya, who was hearing the high-profile Sohrabuddin Sheikh fake encounter case, had died of cardiac arrest in Nagpur on December 1, 2014 when he had gone to attend the wedding of Justice Swapna Joshi’s daughter. He was staying in Ravibhavan. “The rooms were booked by a court assistant hence no room was in the name of Judge Loya,” Fadnavis cleared.

“After the marriage and attending other programmes of the day, Judge Loya returned to Ravibhavan in the night. He chatted with his wife over phone for a long time. At about 4 am, he complained of severe chest pain. After informing his justice friends, he was taken to a multi-speciality hospital. He died in the same hospital,” the Chief Minister said.

Fadnavis further stated that the ‘Caravan’ magazine published a blatantly false report three years after Judge Loya’s death. After the report, Judge Loya’s son and other family members addressed a press conference and said they have no doubts whatsoever on his death.

“The hearing on the matter is pending in Supreme Court and the truth will soon come out,” Fadnavis said.

Frequent fires in forests taking heavy toll of ecosystem, wildlife in State

Nagpur Today : Nagpur News

Nagpur: At a time when forested areas in Maharashtra witnessing a continuous depletion, the frequent fires in vast swathes of jungles, on the other hand, are causing unimaginable damage to ecosystems. The frequent fire events can reduce soil fertility and carbon storage, negatively affecting even those ecosystems whose regular re-growth depends in part on wildfires. The heavy toll of wildlife the fires take is another worrying aspect of the fiery disasters.

Maharashtra has recorded total of 17,976 incidents of forest fires in the past five years. These fires badly affected around 1.25 lakh hectares of woods. Despite concerted efforts by State vForest Department to safeguard biodiversity in forests by controlling fires, the success seems to have eluding them.

According to statistics released by Forest Department, a total of 5844 small and big fires were recorded in forests of state in 2017 with damage to ecosystem in 31,876 hectares. Interestingly, till March 2018, 3000 fire incidents have been reported in state. From 2013 onwards, the incidents of wildfires are on the increase. In 2013, 2928 fires were reported while 2683 in 2014, 1880 in 2015, and 4641 fire incidents were reported in 2016. In the past five years, the fires have taken heavy toll of jungles in 1,16,692 hectares. The count of biodiversity loss is unimaginable.

While single fires can be rejuvenating for certain fire-adapted ecosystems — low-intensity fires promote biodiversity, renew soil nutrients, and may even be necessary for some plants to produce seeds – the repeated fire events can reduce soil fertility and carbon storage, negatively affecting even those ecosystems whose regular re-growth depends in part on wildfires.

The Additional Principal Chief Conservator of Forests R S Yadav said that the incidents of forest fires are on the decline. The figures are being seen as big mainly due to satellite technology. A number of preventive measures are being initiated to control wildfires. Strike force of fire watchers have been formed that keep a hawk eye of wildfires. 11 firefighting units and 1276 fire blowers have been made available. The number of smart phones and vehicles has been increased.

The climate change may be leading to more fires. Some of the sites were protected from wildfires, while others faced a higher number of fires than normal. As climate change creates warmer and drier conditions in fire-prone areas, it will lead to more fires, which leads to more carbon emissions, which leads to more warming, and ultimately more fires.
