HC dismisses petitions of 35 women seeking appointment as nurse-cum-midwife in NMC

Nagpur: Delivering a shattering blow, the Nagpur Bench of Bombay High Court has dismissed petitions of 35 women seeking appointment as nurse-cum-midwife in Nagpur Municipal Corporation.

The petitions were filed by Anamika Bargat and 34 other women petitioners, all residents of Nagpur, seeking appointment letters as nurse-cum-midwife in Nagpur Municipal Corporation in pursuance of their selection through the order of February 16, 2013. The Maharashtra Government had conveyed to the NMC that the select-list has not lapsed and still subsists.

Dismissing the petitions, Justice Vasanti Naik and Justice C V Bhadang at the High Court here have noted that the select-list was published before February 16, 2013 and it has lapsed because as per the one year rule in terms of the Government Resolution of October 19, 2007, the petitioners were not appointed before February 16, 2014. The petitions have been filed on July 30, 2014, long after the select-list lapsed, said the Judges in their order.
Further, the Court has found that no selected candidate has right to be appointed to the post on which she is selected.
Adv Vikram Marpakwar appeared for the petitioners. Advocate Jemini Kasat (NMC) and AGP Ketki Joshi (State) represented the respondents.
