SECTION 16(2)(C) OF CGST ACT, 2017 IS NIGHTMARE FOR HONEST TAXPAYERS : DR. DIPEN AGRAWAL, PRESIDENT-CAMIT

A delegation of Chamber of Associations of Maharashtra Industry & Trade (CAMIT) led by President, Dr. Dipen Agrawal and Chairman Mohan Gurnani along with Bombay Metal Exchange (BME) and Metals Recycling Association of India (MRAI) met Dr. Bhagwat Karad, MoS Finance, GOI at Mumbai today.

The delegation welcomed Dr.Karad with Shawl, Shreefal, floral bouquet and submitted memorandum, highlighting the hardship faced by business community due to Section 16(2) of Central Goods & Service Tax Act (CGST Act). Dr.Karad was also requested to frame recycling policy for non-ferrous metal, to attain the aims of the circular economy.

Dr. Dipen Agrawal said that, CAMIT appreciates the sensitivity shown by government in addressing the concerns of business community raised time to time regarding implementing Goods & Service Tax. Highlighting the adverse effects of Section 16(2)(c) of CGST Act, 2017 Dr. Agrawal said that, it is one of the harshest and scariest provisions of the GST laws and it is nightmare for the honest taxpayers. According to this provision availement of ITC by the purchaser is contingent upon payment of tax by the seller, either in cash or through utilisation of admissible ITC in respect of the said supply. It is beyond comprehension how is it possible for purchaser to ensure that the tax collected from him has been actually paid by the seller in the government treasury or not.

Mohan Gurnani said that, government should ask bureaucrats 1) whether there any mechanism or module in the hands of purchaser to know whether the seller has paid the tax or his ITC is admissible, 2) whether purchaser is bestowed with any legal authority to ensure this compliance by the seller, 3) whether purchaser can sue the seller for not paying the tax and get immediate justice, 4) whether purchaser is placed in a superior economic position vis-a-vis the seller as far as dictating terms are concerned, 5) whether purchaser take the role of an enforcement agency, 6) whether can a layman purchaser command the seller that the purchaser would pay the tax only when seller proves that he has already paid it to the government and 7) whether purchaser can withhold the payment of tax and take it upon himself to pay the same directly to the government on behalf of the seller. If no affirmative answers are given to above questions, then the provisions of Section 16(2)(c) should be immediately reviewed and interest of honest taxpayer should be protected, because law cannot compel a man to do what he is incapable to do, added Mr. Gurnani.

Dr.Karad stated that Narendra Modi government is committed to resolve the issues of GST to satisfaction of trading community and he is convinced that, section 16(2)(c) needs to be amended as the innocent taxpayers should not be burdened with unnecessary compliance for no fault on their end.

Rikab Mehta said that, India needs to enhance Circular Economy by framing recycling policy to minimise carbon emissions and negative impact, on the environment. Highlighting the potential of non-ferrous recycling industry, he said that 35-40% average contribution to the total output of all non-ferrous metals; 25000 micro, small & medium units giving direct/indirect employment to over 20 lakh persons; about 30% of the workforce are skilled women, who specialise in scrap metal sorting; there is almost zero waste discharge and the carbon footprint is about 5-10% compared to primary production through ore reduction.

Sandeep Jain informed Dr.Karad that NITI Aayog has already recommended a Circular Economy Policy for Recycling Industry in April 2022. Having regard to governments initiative on Circular Economy, there is urgent need to make a policy which will enable scrap aggregators to shift from unorganised to organised sector.

Hemant Parekh said to felicitate the transition, provisions of GST & Income Tax laws needs’ to be relaxed. He suggested, to scrap purchased from unregistered dealer, should be exempted provisions of TDS & TCS; under GST tax should be charged, at first stage of transaction i.e. on purchase from unregistered dealer, through Reverse Charge Mechanism (RCM); threshold limit of turnover in case of scrap aggregator be increased from 40 Lacs to 60 Lacs; jurisdictional officer should be held accountable if they fail to take time-bound action against defaulters; system should be designed for early detection of defaulter.

Dr.Karad said he shall ensure that government forms a scrap recycling policy specially for metal scrap processing.

Mitesh Prajapati proposed vote of thanks on behalf of the delegation. Sandeep Jain, Sushil Kothari, Mahendra bhai Mehta, Atul Goyal, Shravan Aggarwal and Pramod Shinde wereprominently present in the meeting informs a press release issued by CAMIT.

Nagpur: The findings revealed by the National Family Health Survey-5 (NFHS) say that an average 18.7% men and 19.8% women in Vidarbha take medication to control their blood pressure (BP). This percentage is less than Maharashtra’s average of 24% and national average of 26.6%.

The NFHS dedicated its survey to hypertension and blood sugar because these two have been major risk factors for cardiovascular diseases, chronic kidney diseases, brain diseases and major causes of premature deaths. The survey has details about gender, age, habitat (urban/rural), education and religion-wise details of the hypertension prevalence in the country.

As per the doctors, not only those who have increased blood pressure but also some of those who are in the pre-hypertensive stage need a BP pill daily. The percentage of such patients is at least 5% fewer in Vidarbha than the state and national average. Doctors attribute these statistics to a lack of awareness and testing in Vidarbha.

The survey:

* 12% women (15-49 years) in Maharashtra have hypertension; 36.6% pre-hypertensive

* 23.1% women taking medicine to lower blood pressure

* 19% men have hypertension, 48% pre-hypertensive

* 24.4% men taking medicine to lower blood pressure

* For both women and men, hypertension increases with age

Nagpur: “Sports develop when they get a platform. Kids are imitators. When they see games being played around, they too turn to the game. The sports festivals, sports competitions introduce new sports, new players come forward. Those who are already playing get new opportunities. Organizing Khasdar Krida Mahotsav is important to create a sports environment with overall sports and player development”, said Olympian Arjuna Award winner Gopal Saini. He appreciated the Union Minister Nitin Gadkari for his concept of Khasdar Krida Mahotsav being organised in Nagpur.

Saini was in Nagpur for the inaugural function of the Athletics Competition under the Khasdar Krida Mahotsav held on Tuesday, May 17 at the Divisional Sports Complex, Mankapur. The Chairman of the Athletics Competition Committee, Dr. Sharad Suryavanshi was present on the occasion.

Saini further said that with the advent of technology in sports, some things have become more accurate and the malpractices in them have been curtailed. Today, the game needs maximum encouragement. Parents must come to the field before the children can enter the arena, appealed Gopal Saini.

In his entire sports career, Gopal Saini, having 17 records in his name, ran barefoot in many competitions of his career. Talking about this, he said, “I used to practice running every day. At that time I used to buy shoes for Rs 15 but it did not last even for 15 days. The shoes used by some senior players were also used. However, they did not support him for long. So I practiced running barefoot and participated in competitions and also won medals. However, now that the rules have been amended, it is not possible to run without a pair of shoes,” he said.

Prime Minister Narendra Modi has worked to promote sports across the country through ‘Khelo India’. In Nagpur, Union Minister Nitin Gadkari conceived the idea of Khasdar Krida Mahotsav.The Festival is a great opportunity for local players. “Today, such an initiative has led to the improvement of sports, the availability of materials, and the creation of opportunities,” Saini said. He also said that the players should take advantage of such opportunities to find a way to further achieve their goal.

Being the National President of Krida Bharati, Gopal Saini highlighted the role being played by Krida Bharati . Nagpur: The Anti-Terrorism Squad (ATS) Nagpur has got custody of the Jaish-e-Mohammed (JeM) terrorist from Jammu & Kashmir who had conducted recce of Dr Hedgewar Smriti Mandir of Rashtriya Swayamsevak Sangh (RSS) in Reshimbag in July last year, according to reports.

According to reports, Raees Ahmed Sheikh Asadulla Sheikh (26), a resident of Khati Mohalla, Chandara, Awantipora town of Pulwama district in J&K, is being thoroughly interrogated by the ATS since the last two days. During interrogation, Raees reportedly told the investigators that a person named Omar, who is operational commander of JeM’s Nawabpur (Pakistan)-based terrorist launching pad, was his handler.

The reports further said that Raees came to Nagpur by a Delhi-Mumbai-Nagpur flight on July 13 and checked into a hotel in Sitabuldi area. The handler had assured Raees that a local man would contact and help him at Nagpur in the operation. However, Raees conducted the reconnaissance on his own as no person contacted him at Nagpur, according to sources.

On July 14, Raees took an auto-rickshaw and reached Reshimbag with the help of Google Map. The location was sent by his handler, sources claimed. His target was to conduct recce of Smriti Mandir. He deboarded the auto near Reshimbag ground in the afternoon. Raees reportedly told the investigators that he took video of Hedgewar Mandir while walking through Reshimbag ground and pretending that he was talking to someone on cell phone. He later shared the video with his handler on WhatsApp but got admonished over poor quality of the video. He was instructed to again shoot the video. However, fearing police, Raees switched off his mobile phone.

Sources said, Raees then called the auto-rickshaw driver and asked him to take to a Masjid. The auto driver dropped him at a Masjid near Santra Market gate where he stayed for the day and returned to the hotel in the evening. On July 15, Raees returned to Srinagar by a Nagpur-Delhi-Srinagar flight, sources added.

A case under relevant sections of Unlawful Activities (Prevention) Act was registered against Jaish-e-Mohammad terrorist at Kotwali Police Station. The probe was transferred to ATS on the instructions of the then DGP Sanjay Pandey.
